§1. General Provisions

  1. This Privacy Policy defines the principles of processing personal data and using cookies in connection with the use of the ONE. bag studio online store, available at www.onebagstudio.com (hereinafter: "Store").
  2. The personal data controller is Ewelina Ludwig, conducting business activity under the name of "EWELINA LUDWIG" with its registered office at ul. Bernardyńska 16/9, 85-029 Bydgoszcz, entered into the CEIDG, NIP: 1133023259, REGON: 387559530 (hereinafter referred to as the "Controller").

§2. Purposes and Basis of Personal Data Processing. Scope of data.

The Administrator processes personal data for the following purposes:

  1. Fulfillment of orders – data is processed on the basis of Article 6 paragraph 1 letter b of the GDPR (necessity to perform the contract).
  2. Handling of inquiries – data are processed on the basis of Article 6 paragraph 1 letter f of the GDPR (legitimate interest of the Administrator).
  3. Marketing and Newsletter – data are processed on the basis of Article 6 paragraph 1 letter a of the GDPR (Client's consent) or Article 6 paragraph 1 letter f of the GDPR (legitimate interest of the Administrator in promoting the activity).
  4. Analysis and optimization – data is collected to improve the functionality of the Store and personalize the offer pursuant to Article 6 paragraph 1 letter f of the GDPR.
  5. Fulfillment of legal obligations – data are processed on the basis of Article 6 paragraph 1 letter c of the GDPR.
  6. Profiling and advertising activities – data are processed automatically for the purposes of analysing customer behaviour, adapting marketing content and optimising the offer, in accordance with Article 6 paragraph 1 letter f of the GDPR.

When placing an order in the Store, the Customer provides the following personal data:

  • Email address
  • Address details – residential address, postal code, city
  • Phone number
  • Name and surname

In case of using the Newsletter service, the Customer only provides his/her e-mail address.

Providing personal data by the Customer is voluntary, but necessary to make transactions within the Store. When the Customer subscribes to the newsletter (Newsletter), electronic messages containing commercial information about promotions and new Products available in the Store will be sent to his/her e-mail address.

 

§3. Data Recipients

  1. The Administrator may share personal data with the following entities:
    • providers of analytical and advertising tools such as Google Analytics, Meta Ads Manager,
    • courier companies to fulfill orders,
    • payment system operators,
    • IT service providers.
  1. Data may be transferred outside the European Economic Area only in accordance with the provisions of the GDPR (e.g. to entities with the EU-US Privacy Shield certificate).
  2. The Customer's personal data are protected by the Administrator against unauthorized use, modification or destruction through the use of appropriate technical and organizational measures.

 

§4. Data Storage Period

  1. Data processed for the purposes of order fulfillment are stored for the period necessary to execute the contract and until the expiry of the limitation periods for claims, as well as for the period required by law regarding the storage of accounting and tax documentation.
  2. Data processed for marketing purposes are stored until consent is withdrawn or an objection is raised.
  3. Data processed for analytical purposes are stored in accordance with the policies of analytical tool providers, e.g. Google Analytics (up to 2 years).

 

§5. Cookies

  1. What are cookies? Cookies are small text files stored on the Customer's device, which enable the Store to function properly, traffic analysis and content personalization.
  2. Purposes of using cookies:
    • ensuring the proper functioning of the Store,
    • analysis of store traffic,
    • conducting marketing activities,
    • improving user comfort.
  1. Types of cookies:
    • Necessary – required for the website to function properly.
    • Analytical – used to analyze website traffic (e.g. Google Analytics).
    • Marketing – enabling personalization of advertising content (e.g. Meta Pixel).
  1. Cookie management: The customer can change cookie settings in their browser. However, disabling cookies may limit the functionality of the Store.

 

§6. Customer Rights

The customer has the right to:

  1. Access to your data.
  2. Rectification of incorrect data.
  3. Delete your data (“right to be forgotten”).
  4. Limitations on data processing.
  5. Transferring data to another administrator.
  6. Object to data processing.
  7. Withdraw your consent to data processing at any time.
  8. Submitting a complaint to the President of the Personal Data Protection Office, with its registered office in Warsaw at ul. Stawki 2, 00-193 Warsaw.

At any time, it is possible to withdraw consent to the processing of data for marketing purposes or consent to the sending of commercial information by sending an e-mail containing information about the withdrawal of consent and an indication of which consent is in question to the address: hello@onebagstudio.com. After withdrawing the consent/consents, the Client will not receive marketing materials or commercial information from the Administrator. Withdrawal of consent/consents does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. The Client has the right to access the content of their data and to rectify, delete, limit processing and object to processing. For this purpose, the Client should contact the Administrator by e-mail at the address: hello@onebagstudio.com . After filing an objection, the Client will not receive any marketing materials from the Administrator.

 

§7. Changes to the Privacy Policy

  1. The Administrator reserves the right to make changes to the Privacy Policy in order to adapt it to applicable legal provisions or to introduce new functionalities of the Store.
  2. The Customer will be informed of any changes to the Policy by publishing a new version on the Store’s website.
